Welcome to ChronicleMyFamily.com (the "Service" or "Platform"). These Terms of Service ("Terms") form a legally binding agreement between you ("you," "User," or "your") and ChronicleMyFamily LLC, located in Blaine, Minnesota ("we," "us," or "our") regarding your access to and use of the Service, including our website at chroniclemyfamily.com and any related mobile applications, features, or content (collectively, the "Service").

By accessing, registering for, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service independently. If you are under the age of majority in your jurisdiction, you represent that you have your parent's or legal guardian's permission to use the Service and agree to these Terms on their behalf. We may terminate accounts of users who do not meet these requirements.

1.1 Minors and COPPA

If the Service collects personal information from users under 13, we comply with the Children's Online Privacy Protection Act (COPPA) by obtaining verifiable parental consent where required. We do not knowingly collect personal information from children under 13 without such consent. Parents or legal guardians are solely responsible for supervising minors' participation in the Service, including any text answers, media links, or group interactions. If you believe a child under 13 has provided information without parental consent, contact us immediately at admin@chroniclemyfamily.com.

2. User Accounts

To access certain features (e.g., creating or joining family groups, uploading content, or posting answers), you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access.
  • Be responsible for all activities under your account.

We reserve the right to suspend or terminate accounts for violations of these Terms.

3. User-Generated Content

The Service allows users to upload images and videos (stored on Bytestream, a third-party provider), post text responses/answers to questions within family groups, and share other materials ("User Content"). We do not store images or videos directly; our database only holds links to content hosted by Bytestream. Text content (e.g., family group answers) is stored on our systems but provided solely by users.

3.1 Your Responsibilities and Representations

By submitting User Content, you represent and warrant that:

  • You own or have all necessary rights, licenses, consents, and permissions to submit and grant the rights below.
  • The User Content does not infringe any third-party rights (copyright, trademark, privacy, publicity, etc.) and complies with all applicable laws.
  • The User Content is not obscene, defamatory, libelous, threatening, harassing, abusive, discriminatory, hateful, violent, illegal, or otherwise objectionable.
  • You will not submit User Content containing malware, spam, or harmful code.

You are solely responsible for your User Content and any consequences from it. We do not pre-screen, endorse, or control User Content.

3.2 Our Role and Liability Disclaimer

We act as a passive conduit for User Content. Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), we are not treated as the publisher or speaker of User Content provided by others and are not liable for any objectionable, illegal, harmful, or infringing User Content—including images, videos (via Bytestream links), or text answers/responses in family groups. Liability rests with the user who submitted it.

The Service relies on third-party providers like Bytestream for media storage and hosting. We are not responsible for their availability, security, performance, data loss, or compliance with their own terms.

For copyright claims, we comply with the DMCA Safe Harbor provisions (17 U.S.C. § 512). We are not liable for infringement by User Content if we follow notice-and-takedown procedures (see Section 4).

We reserve the right (but have no obligation) to review, remove, disable access to, or edit User Content at our sole discretion for any reason, including violations of these Terms or to protect users/others. Such actions do not create liability for us.

3.3 License Grant to Us

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify (for formatting/display), distribute, display, and perform the User Content solely to operate, promote, and improve the Service (including sharing within family groups).

3.4 Family Groups and Shared Content

The Service enables users to create or join private family groups where members can post text responses to questions and share links to media. You acknowledge that:

  • Content shared in family groups is intended for private use among group members only.
  • You are responsible for obtaining explicit consent from all individuals (including minors) depicted, referenced, or involved in any User Content before posting.
  • Parents or legal guardians are solely responsible for monitoring and supervising minors' participation, including any text answers or media links shared in groups. We do not monitor private group content and rely on users to report violations via our reporting tools or contact methods.

4. DMCA Notice and Takedown Procedure

If you believe User Content infringes your copyright, submit a written notice to our designated DMCA agent including:

  • Your signature (electronic or physical).
  • Identification of the copyrighted work.
  • Identification of the infringing material (e.g., link or location).
  • Your contact information.
  • Good-faith statement of unauthorized use.
  • Statement under penalty of perjury that the information is accurate and you are authorized to act.

We may terminate repeat infringers' accounts.

5. Acceptable Use

You agree not to:

  • Violate laws or third-party rights.
  • Harass, impersonate, or spam others.
  • Interfere with the Service (e.g., hacking, overloading).
  • Use the Service for commercial purposes without permission.
  • Post prohibited content (as described in Section 3 and Section 6).

6. Prohibited Conduct

In addition to Section 5, you may not:

  • Post User Content that promotes hate speech, violence, self-harm, child exploitation, or illegal activities.
  • Harass, bully, dox, or impersonate others (including family members).
  • Share personal information of others without their explicit consent.
  • Use the Service to solicit minors or engage in predatory behavior.
  • Engage in any conduct that could reasonably harm minors or family group dynamics.

Violations may result in content removal, group suspension, account termination, or other actions.

7. Intellectual Property

The Service (excluding User Content) is owned by us or our licensors and protected by copyright, trademark, and other laws. You receive a limited, non-transferable license to use the Service as intended.

8. Termination

We may suspend or terminate your access at any time for violations, at our discretion, or if required by law. Upon termination, your license ends, but Sections 3.3, 8–13 survive.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED) AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, USER CONTENT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS (WHICHEVER IS GREATER).

10. Indemnification

You agree to indemnify, defend, and hold us (and our affiliates, officers, etc.) harmless from claims, damages, losses, or expenses (including attorneys' fees) arising from your User Content, use of the Service, or violation of these Terms.

11. Dispute Resolution – Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in Anoka County, Minnesota, under the rules of the American Arbitration Association, rather than in court (except for small claims). You waive any right to a jury trial or to participate in a class action lawsuit. This does not prevent you from filing claims with government agencies (e.g., FTC for COPPA issues).

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflicts of law principles. Subject to the arbitration clause above, any non-arbitrable disputes shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota.

13. Changes to Terms

We may update these Terms. We will post changes and update the "Last Updated" date. Continued use after changes constitutes acceptance.

14. General Provisions

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements. If any provision is held invalid or unenforceable, the remainder remains in effect. Our failure to enforce any right does not constitute a waiver. We are not liable for delays or failures due to causes beyond our reasonable control (force majeure), including natural disasters, acts of government, or internet disruptions.
